Mgr. Tomáš Otruba
Experience, Legal Specialization: Tomáš Otruba is a partner of BBH and heads the Banking and Financial Services departments. Mr. Otruba specializes in banking, finance, insurance and capital markets law. Over the course of his professional practice, he has also acquired extensive experience and knowledge in the areas of M&A and Real Estate. Mr. Otruba has acted for national and multi-national banking and other financial institutions, both domestically and throughout Europe, in many of the most significant commercial and financial transactions and restructurings and has handled bond issues (including mortgage debentures), whether listed or privately placed. Tomáš’ work concentrates on the variety of debt and equity, balance sheet and asset-based transactions as a part of his daily practice. One of the cornerstone components of his practice is FX and other derivative documentation based on the international standards published by the ISDA.
In 2003, Tomáš led the team which acted as structuring legal counsel to Home Credit Finance a.s. and structured the first ever rated and completed securitization transaction not only in the Czech Republic, but in the whole of Central and Eastern Europe. Additionally he structured and advised on numerous other asset-backed deals, which do not have a public rating, such as the asset backed financing of a major leasing company. The extent of Tomáš’ experience and reputation is supported by the fact that, due to his daily capital market practice, he is a member of the Appeal Committee of the Board of Directors of the Czech National Bank and is actively engaged in consultations for this public regulatory body on questions relating to the capital markets (recently including the implementation of MiFID in the Czech Republic).
Tomáš Otruba is a member of the CEE Committee of the ISDA Association and is one of the repeatedly recommended lawyers in the field of banking and finance in the Czech Republic as well as in international circles. For example, he has been cited with distinction in renowned publications, including Chambers Global (2006 edition) and European Legal Experts 2006, where Mr. Otruba was not only included in their category of recommended lawyers but they also published his personal profile. Tomáš Otruba joined BBH in 2001 after five years of practice with Balcar Polansky Norton Rose. In 2003, Tomáš became a partner at the firm. Tomáš was educated at Charles University in Prague, graduating in 1996 with honors, subsequently becoming a member of the Czech Bar Association. He also studied European and International private law at the University of Regensburg, Germany in 1995.
